1. Acceptance of the Terms

These Terms and Conditions ("Terms") govern access to and use of wheniseeus (the "App" or the "Service"), operated by Dapur Tecnología ("we", "the Company"). By creating an account, signing in, or using the App in any way, you agree to be bound by these Terms. If you don't agree, you must not use the Service.

To use wheniseeus you must be at least 18 years old, or the age of legal majority in your jurisdiction, and have the legal capacity to enter into binding contracts.

2. Service Description

wheniseeus is a conversational assistant based on artificial intelligence that lets you make queries in natural language and receive automatically generated answers, with a conversation history tied to your account. The Service may incorporate third-party models for language processing.

We reserve the right to modify, add, or discontinue Service features at any time, with or without prior notice, when technical, business, or legal reasons justify it.

3. Account Registration

• You must provide a valid email address and a secure password to create your account.
• You are responsible for keeping your credentials confidential and for all activity carried out under your account.
• You must notify us immediately of any unauthorized use of your account by writing to [email protected].
• Creating accounts with false information, impersonating others, or sharing credentials with third parties is not allowed.

4. Acceptable Use

By using wheniseeus, you agree not to:

• Use the Service for illegal or fraudulent activities, or activities that infringe the rights of third parties.
• Generate, request, or distribute defamatory, discriminatory, violent, or sexually explicit content involving minors, or content that promotes hatred or self-harm.
• Attempt to breach, overload, or reverse-engineer the Service's infrastructure, models, or security measures.
• Use bots, automated scraping, or any unauthorized means to extract data or content from the App at scale.
• Resell, sublicense, or commercially exploit the Service without express written authorization.

We reserve the right to suspend or delete accounts that violate these conditions.

5. AI-Generated Content

wheniseeus's responses are automatically generated by artificial intelligence models and may contain errors, inaccuracies, or outdated information. The Service does not replace professional medical, legal, financial, or other specialized advice. You are responsible for independently verifying any relevant information before acting on it.

We do not guarantee that responses are accurate, complete, or fit for a particular purpose.

6. Coding Agent, VS Code Extension and Remote Sessions

The wheniseeus VS Code extension ("Extension") includes an agent mode and a remote mode ("VS Code remoto") in which the AI can propose creating, modifying or deleting files in the folder you have open, and running commands in a terminal on your computer. By using these features you acknowledge and agree that:

• Everything the AI proposes is a suggestion. Proposed file changes and commands are generated automatically and may be wrong, incomplete, insecure or harmful to your project or system.
• You decide and you are responsible. Nothing is applied or executed until you explicitly approve it (in VS Code, or from the web app with your PIN). Each approval is your own decision, made on your own computer and project, and you are solely responsible for reviewing what you approve and for its consequences.
• Keep backups. You are responsible for keeping your code under version control (for example git) or backed up before approving changes or commands.
• Your computer, your environment. Changes and commands run on your device, not on our servers. Dapur Tecnología does not monitor, review or approve the actions you take with the Extension.
• Safeguards are not guarantees. The Extension includes safety measures (such as approval prompts, a remote-approval PIN, protected files, command restrictions and review requirements), but they reduce risk and do not eliminate it. You must not disable, bypass or work around them.
• Account security. You must keep your wheniseeus account credentials and your remote-approval PIN confidential, and disable remote mode if you suspect unauthorized access.

The limitation of liability in section 11 applies in full to any loss of data, damage to software or systems, or other harm arising from changes or commands you approve through the Extension.

7. Pro Subscription and Payments

wheniseeus offers a paid subscription plan ("Pro Plan") with additional features, processed through PayPal via recurring monthly charges. By subscribing:

• You accept the periodic charge for the plan in effect at the time of subscription, expressed in US dollars (USD).
• The subscription renews automatically at the end of each period, unless you cancel it before the renewal date.
• You may cancel at any time from the App's subscription section or directly from your PayPal account; cancellation prevents future charges but does not automatically refund the period already billed.
• Refund conditions are detailed in our Refund Policy.

We reserve the right to change subscription prices, giving reasonable advance notice to active users.

8. Intellectual Property

The name "wheniseeus", its logo, interface, design, and source code are the property of Dapur Tecnología or its licensors, and are protected by intellectual property laws. You are not granted any ownership rights over the Service, other than the limited, non-exclusive, non-transferable license to use it under these Terms.

You retain ownership of the queries you submit. You grant us a limited license to process them for the sole purpose of providing you the Service.

9. Privacy

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

10. Service Availability

We strive to keep the Service continuously available, but we do not guarantee it will run without interruptions, errors, or delays, especially due to maintenance, third-party failures (including infrastructure or AI model providers), or force majeure.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Dapur Tecnología will not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the Service, including decisions made based on AI-generated responses. Our total liability for any claim related to the Service will not exceed the amount you paid in the last three (3) months.

12. Account Suspension and Cancellation

We may suspend or cancel your account, with or without prior notice, in the event of a breach of these Terms, fraudulent use, a security risk, or a legal requirement. You may also delete your account at any time by contacting us at [email protected].

13. Changes to these Terms

We may update these Terms periodically. Changes take effect when published on this page, updating the "Last updated" date. Continued use of the Service after a change means you accept the new Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Argentine Republic. Any dispute arising from these Terms or the use of the Service will be submitted to the competent ordinary courts of Argentina, waiving any other venue that might otherwise apply.
